Age and content
Why Fictor is 18+
Fictor is not an adult content platform. We're an AI platform — and AI requires adult reasoning, intent, and judgment. That's why we ask everyone using Fictor to confirm they're at least 18, regardless of what they're writing. Where required by law, we may apply additional age verification beyond self-disclosure.
What Fictor allows, and what it doesn't
Fictor is a creative platform where humans and AI both make work. We hold AI to a stricter standard than humans — not because AI can't write certain things, but because it shouldn't without a person's reasoning and intent behind it.
A short list of absolutes apply regardless of who's writing:
- No content sexually depicting minors, real or fictional. Zero tolerance.
- No content depicting or instructing real-world harm.
- No content depicting real, identifiable individuals in sexual or defamatory ways.
- No content inciting violence, hatred, or discrimination against people based on protected characteristics.
- No malicious code, exploits, phishing material, or other content designed to compromise systems or deceive users.
Outside those lines, Fictor doesn't gate human creative work. We trust you. If you misuse the platform, we suspend you — that's how trust works.
Fictor is not designed for explicit content and does not afford it as a feature. The AI may sometimes go further than you intended — bad prompts, natural story consequences, surprises in the underlying model's training. We work to keep it within bounds; we don't pretend it can never drift. If the AI produces something off, report it to report@fictor.ai.
Your content and ours
You own what you create
You retain full ownership of all original content you bring to or create on Fictor — your stories, drafts, notes, and uploads. Output produced by our AI in response to your direction is yours to use as you see fit. To do its job, Fictor needs a limited, non-exclusive license from you to host, store, process, and display your content strictly for the purpose of operating the Service for you. This license ends when you delete your content or close your account.
We never train on your work
Not your stories, drafts, chats, or uploads. Not by us, and not by any partner we route through. Reading your work to answer your prompt isn't training — using it to teach a model would be. We don't.
Your responsibility outside the platform
AI-generated content reflects patterns from the underlying model's training, which we did not perform and which is similar in scope to other frontier AI systems. We make no warranty that any output is original or free of resemblance to existing works. You agree not to use Fictor to generate content that infringes third-party rights, and you take full responsibility for ensuring your use of generated content complies with applicable law if you choose to export or distribute it outside the platform.
You agree to indemnify and hold Fictor harmless against claims arising from your use of generated content, including claims of copyright, trademark, or personality-rights infringement.
Privacy and data
What we collect
- Account information — email, username, authentication data when you register.
- Content you bring — stories, prompts, characters, uploads, and other creative material you input into the Service.
- Usage data — features used, actions taken, errors encountered. We do not log your content as part of usage telemetry.
- Device and log data — browser type, IP address, access times, referring URLs, error logs.
How your work is processed
The vast majority of AI processing on Fictor runs on infrastructure we operate directly. Our AI reads your prompts and relevant context to do its work; that processing happens on Fictor-controlled hardware. In certain events we may use third-party services to perform AI processing. Your content is never sent to a service provider that trains on it.
Your work is encrypted at rest. A break-in to our storage yields ciphertext, not prose. The AI you invite has access to your work to do its job; nothing else does.
When we may access your data
Our team does not routinely read user content. We reserve the right to access, audit, or review accounts and their data when necessary for platform safety (investigating violations or threats), legal compliance (subpoenas, court orders, mandatory reporting requirements), or to protect Fictor or our users. We will not use audited content for training, marketing, or any purpose beyond the issue prompting the access.
Your rights
- Access and export — request a copy of your personal data at any time.
- Correct — update inaccurate information via your account settings.
- Delete — request deletion of your account and associated data.
- Opt out of marketing — unsubscribe from promotional emails via the link in any email.
For privacy questions or requests, email privacy@fictor.ai.
Billing and cancellation
Subscription model
Fictor is a monthly subscription. Your tier sets your priority, not a usage ceiling. There are no quotas, no tokens, no per-word charges.
Cancellation
You can cancel anytime from your account settings. Cancellation takes effect at the end of your current billing period — you keep access until then. We don't pro-rate partial months.
What we don't refund
- You didn't like the output the AI produced.
- Content the AI declined to produce within our absolute prohibitions.
- Slower response under heavy load — your tier guarantees a reply, not a millisecond budget.
- User error — wrong settings, accidental generation, duplicate runs.
- Excessive or automated requests that violate these terms.
When we do issue credits
If a verified failure on our end interrupted your subscription's intended use, we may issue a service credit at our discretion. Email billing@fictor.ai with the details.
Disputes and chargebacks
Please contact billing@fictor.ai before initiating a chargeback. Chargebacks incur fees and administrative cost that ultimately raise prices for everyone. Accounts with unresolved chargebacks may be suspended pending resolution.
Terms of service
Agreement
By accessing or using Fictor (the "Service"), you agree to these terms. If you don't agree, don't use the Service.
What Fictor is
Fictor is a creative platform with three surfaces — the Shelf for reading and listening, the Creative space for AI-led making (Story Riff, Universe, Soundstage), and the Writing space for human-led writing. Our AI is present across all three surfaces. Features and surfaces ship over time; you'll always know what your tier currently includes from your account settings.
Acceptable use
You agree not to:
- Violate the absolutes listed under "Age and content."
- Use the Service to generate content that infringes third-party rights, or distribute such content outside the platform.
- Attempt to bypass authentication, rate limits, or safety mechanisms.
- Resell, redistribute, or expose Service capabilities to third parties without authorization.
- Use automated systems to extract bulk content beyond what's offered through documented APIs.
Violations may result in suspension or termination. Severe violations are terminal on first offense. We generally suspend only for violations of these terms, but we reserve the right to suspend or terminate accounts at our sole discretion, with or without notice, to protect the platform or its users.
Service availability
The Service is provided "as is" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Fictor does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Disputes
Before any formal proceeding, please email legal@fictor.ai. We'll attempt informal resolution within 30 days. If that fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, on an individual basis. You waive any right to a jury trial, and any right to participate in class actions or class-wide arbitration. These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions.
Changes
We may update these terms from time to time. Material changes will be announced in-product or by email. Continued use after a change means you accept the updated terms.
